Trace Exit — Terms of Service

These Terms of Service ("Terms") govern your use of the Trace Exit API and related services. By using Trace Exit, you agree to these Terms.

1. Contracting party

The Trace Exit service is provided by Server Armour (Pty) Ltd, a company incorporated in the Republic of South Africa, trading as Trace Exit ("Trace Exit", "we", "us", or "Provider").

Card statements and invoices may show the Provider’s registered legal name and/or a Trace Exit descriptor (for example TRACEEXIT). References in these Terms, the Privacy Policy, Data Processing Addendum, and Acceptable Use Policy to “Trace Exit” mean the Provider under that trading name, unless the context requires the registered legal name.

A dedicated Trace Exit company may later become the Provider; we will update these Terms and notify you as required by law when that happens.

2. Service and Consumer Protection Act (CPA)

Trace Exit provides IP intelligence APIs (geolocation, anonymizer signals, risk/fraud scores) on a best-effort basis, primarily intended for business / developer (B2B) use.

If you are a juristic person with an asset value or annual turnover equal to or exceeding the threshold determined by the Minister under the South African Consumer Protection Act 68 of 2008 ("CPA") (currently R2,000,000), you acknowledge that the CPA does not apply to these Terms.

3. No Warranty of Accuracy

IMPORTANT NOTICE UNDER SECTION 49 OF THE CPA:

The data provided by Trace Exit may be incomplete, stale, or incorrect. You are solely responsible for any enforcement and payment decisions (such as kicks, declines, or challenges) made based on this data. To the maximum extent permitted by South African law, we disclaim all warranties, express or implied, including fitness for a particular purpose.

4. Accounts & Keys

API keys are confidential. You are fully responsible for all usage and activity under your keys. We reserve the right to revoke keys or suspend accounts for suspected Acceptable Use Policy (AUP) violations or non-payment.

5. Acceptable Use and Data Protection

You agree to comply with our Acceptable Use Policy (AUP). No stalking, unlawful scraping, bulk internet enumeration, or circumventing free-tier limits.

You must also comply with the Protection of Personal Information Act 4 of 2013 ("POPIA") and any other applicable data protection legislation when using Trace Exit. Processing of personal information is further described in our Privacy Policy and Data Processing Addendum.

6. Fees

Plans, quotas, overages, and bursts are described on our pricing page. Failed payments will result in a grace period followed by a downgrade to the Free tier. Annual plans may auto-renew; you may cancel at any time via the dashboard in accordance with Section 14 of the CPA (if applicable).

Paid subscriptions are billed by the Provider through Stripe. The merchant of record is Server Armour (Pty) Ltd trading as Trace Exit.

7. Related products

Server Armour products may use Trace Exit under a separate commercial agreement. That arrangement does not grant you rights to Server Armour products, and a Trace Exit subscription does not grant rights to Server Armour products.

8. Limitation of Liability

Except for liability arising from gross negligence or willful misconduct, and to the extent permitted by South African law, our total cumulative liability to you for any claims arising out of these Terms is limited to the fees paid by you to us in the 12 months preceding the claim (or USD 100/ZAR equivalent if you are on a free tier).

9. Governing Law and Jurisdiction

These Terms and your use of Trace Exit shall be governed by and construed in accordance with the laws of the Republic of South Africa. You consent to the non-exclusive jurisdiction of the High Court of South Africa for any disputes arising out of or in connection with these Terms.
